CONDITIONS.
These Terms govern your access to and use of the Airmarkt Platform. Last updated: 14 July 2026.
Who We Are
Airmarkt ("Airmarkt", "we", "us", "our") is operated by Airmarkt Ltd, a company registered in England and Wales at 9 Riverdale Gardens, Twickenham TW1 2BX ("registered office"). You can contact us at sara@airmarkt.com.
These Terms and Conditions ("Terms") govern your access to and use of the website airmarkt.app and all related services (together, the "Platform"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform.
What Airmarkt Is
Airmarkt is a wholesale marketplace that connects CPG (consumer packaged goods) brands ("Brands") with independent retail and hospitality buyers ("Buyers", together with Brands, "Users"). Airmarkt allows Brands to list products, Buyers to place orders, and facilitates payment for those orders through our payment processor.
In addition to the marketplace shop, the Platform includes two content features: Reels (short video posts) and Tweets (short text posts), which Users can post, view, and interact with.
Airmarkt is not a party to the contract of sale between a Brand and a Buyer. Airmarkt does not manufacture, own, warehouse, inspect, or ship any products listed on the Platform. Airmarkt's role in the marketplace is limited to providing the marketplace infrastructure, order management, and payment facilitation described in these Terms.
Eligibility and Accounts
3.1 To use the Platform you must be at least 18 years old and have the authority to bind the business you represent.
3.2 When you register, you agree to provide accurate, current, and complete information about your business, and to keep this information up to date.
3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at sara@airmarkt.com if you suspect unauthorised use of your account.
3.4 We may refuse to register any account, or may suspend or close an existing account, at our discretion, including where we reasonably believe the information provided is false or the account poses a risk to the Platform or other Users.
Brand Listings
4.1 Brands are solely responsible for the accuracy of their product listings, including descriptions, pricing, images, stock availability, minimum order quantities, and any allergen or regulatory information required by law.
4.2 Brands must hold all necessary licences, permits, and certifications required to manufacture, market, and sell their products, and must ensure products comply with applicable UK product safety, labelling, and food/beverage regulations.
4.3 Airmarkt does not verify or endorse the accuracy of any listing and accepts no liability for errors or omissions in Brand-supplied content.
Reels and Tweets
5.1 What they are. Reels are short video posts and Tweets are short text posts that Users may publish on the Platform. Reels and Tweets are user-generated content and do not represent Airmarkt's own views or endorsement.
5.2 Ownership and licence. You retain ownership of any Reel, Tweet, or other content you post. By posting content, you grant Airmarkt a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute that content on the Platform and in related marketing materials, for as long as the content remains posted (and, for a limited period afterward, in backups or where already shared by other Users).
5.3 Public visibility. Reels and Tweets are, by default, visible to other Users of the Platform. Do not post anything you do not want to be publicly visible. Airmarkt is not responsible for content that other Users screenshot, share, or repost outside the Platform.
5.4 Content standards. You must not post a Reel, Tweet, or any other content that:
- is false, misleading, or defamatory, including false claims about a Brand's or competitor's products;
- infringes any third party's intellectual property, privacy, or other legal rights;
- is unlawful, obscene, hateful, or harassing;
- discloses another User's confidential or personal information without consent; or
- amounts to spam or unauthorised advertising unrelated to the Platform's purpose.
5.5 Moderation and removal. We may, but are not obliged to, review, moderate, or remove any Reel or Tweet that we reasonably believe breaches these Terms, without prior notice.
5.6 Deletion. You may delete your own Reels and Tweets at any time. Deleted content is removed from public view immediately and permanently deleted from our systems within 30 days, as set out in our Privacy Policy.
Orders and Contract Formation
6.1 When a Buyer places an order through the Platform, this constitutes an offer to purchase from the relevant Brand. A binding contract of sale is formed directly between the Buyer and the Brand once the Brand accepts the order (or, where stated on the Platform, automatically on order confirmation).
6.2 Airmarkt is not a party to this contract of sale and has no liability for a Brand's failure to fulfil, or a Buyer's failure to pay for, an order, beyond the payment facilitation role described in Section 7.
6.3 Order confirmation, expected delivery timeframes, and any minimum order requirements are displayed at checkout and form part of the contract between Buyer and Brand.
Payments and Fees
7.1 All payments made through the Platform are processed by our third-party payment provider, Mollie. By placing or fulfilling an order, you agree to Mollie's applicable terms of service.
7.2 Prices displayed on the Platform are in GBP (£) and are inclusive/exclusive of VAT as stated on the relevant listing.
7.3 Airmarkt charges Brands a transaction fee of between 8% and 12% on the value of each completed order, deducted at the point of settlement. This fee is in addition to, and separate from, the card processing fees charged by our payment processor, Mollie, which are currently:
- UK consumer debit/credit cards: 1.20% + £0.20 per transaction
- UK business cards and EEA-issued cards: 2.90% + £0.20 per transaction
- Non-EEA/international cards: 3.25% + £0.20 per transaction
Mollie's rates are set by Mollie, not Airmarkt, and may change from time to time; the current rates can be confirmed at mollie.com/pricing. Buyers are not charged a fee to use the Platform. Airmarkt's own fee rate is published on our Pricing page and may be updated from time to time with reasonable notice to affected Users.
7.4 Payment is due at the time an order is confirmed unless otherwise agreed between Brand and Buyer and reflected in the Platform's checkout flow.
7.5 Refunds, where applicable, are processed back through the original payment method via Mollie, subject to the Shipping & Returns Policy.
Shipping, Delivery and Returns
8.1 Brands are solely responsible for the shipping, delivery, and fulfilment of orders placed through the Platform. Airmarkt does not handle logistics, warehousing, or delivery of any product.
8.2 Delivery timeframes and shipping costs are set by each Brand and displayed at checkout.
8.3 Returns, refunds, and disputes over damaged, incorrect, or non-delivered goods are to be resolved directly between the Buyer and the Brand in accordance with our Shipping & Returns Policy. Airmarkt may, at its discretion, provide a mediation point of contact but is under no obligation to resolve such disputes or to issue refunds itself.
Buyer Obligations
9.1 Buyers agree to provide accurate delivery and billing information and to make payment for confirmed orders in a timely manner.
9.2 Buyers must have a genuine business need to purchase wholesale goods and must not use the Platform to place orders for personal or non-commercial resale purposes unless permitted by the relevant Brand.
Prohibited Use
You must not use the Platform to:
- list, sell, or purchase counterfeit, stolen, illegal, or unsafe goods;
- infringe any third party's intellectual property, privacy, or other legal rights;
- engage in fraud, money laundering, or other financial crime;
- circumvent the Platform's payment system to avoid applicable fees;
- upload false, misleading, or defamatory content, including in Reels or Tweets; or
- interfere with the proper functioning of the Platform, including through unauthorised automated access.
We may investigate suspected breaches and take any action we consider appropriate, including suspending or terminating accounts, removing content, and reporting conduct to relevant authorities.
Intellectual Property
11.1 The Airmarkt name, logo, and Platform design are the intellectual property of Airmarkt Ltd and may not be used without our written permission.
11.2 Brands retain ownership of their product content (descriptions, images, branding) but grant Airmarkt a non-exclusive licence to display this content on the Platform and in related marketing materials for the purpose of operating the marketplace. Ownership and licensing of Reels and Tweets is set out in Section 5.
Liability
12.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
12.2 Subject to Section 12.1, Airmarkt's total liability to you arising out of or in connection with these Terms, whether in contract, tort, or otherwise, is limited to the greater of £100 or the total fees paid by you to Airmarkt in the 12 months preceding the claim.
12.3 Airmarkt is not liable for any indirect or consequential loss, loss of profits, loss of business, or loss of data.
12.4 Airmarkt is not liable for the acts or omissions of Brands or Buyers, including product defects, late or non-delivery, or non-payment, nor for content posted by Users in Reels or Tweets.
Suspension and Termination
13.1 We may suspend or terminate your account, with or without notice, if you breach these Terms, if we reasonably suspect fraudulent or illegal activity, or if required to do so by law or by our payment provider.
13.2 You may close your account at any time by contacting sara@airmarkt.com. Closure does not affect obligations arising from orders placed prior to closure.
Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will provide reasonable notice via email or a notice on the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
Complaints
If you have a complaint about the Platform, contact sara@airmarkt.com. We will aim to acknowledge complaints within 2-4 business days.
Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
